Transaction Security
Our objective: to help you complete your sale under the right conditions, with complete peace of mind.
The private sale of a yacht requires particular care to mitigate potential legal and administrative risks. We become involved at an early stage to review the key legal and administrative aspects of the transaction and help ensure a secure and transparent process.
Encumbrance status: often overlooked, but essential
Many yacht owners are unaware of this important requirement. Without up-to-date confirmation of the vessel’s encumbrance status, the transfer of ownership with the French Departmental Directorate for Territories and the Sea (DDTM) may be refused or significantly delayed. We address this matter at an early stage to anticipate potential obstacles and secure the transaction from the outset.
- Prompt handling of the required procedures
- Rigorous follow-up with the relevant authorities
- A secure transaction without unnecessary administrative delays
Requesting an encumbrance certificate
Before any transfer of ownership, it is essential to verify the vessel’s legal status. On your behalf, we obtain confirmation of the vessel’s encumbrance status from the competent commercial court, namely the court with jurisdiction over the yacht’s place of registration. This verification helps to:
- Confirm that the vessel is free from mortgages or other security interests
- Ensure that the yacht can be transferred free and clear
- Support a transparent transaction between the parties
